Plenty of discussion, no decisions on ballfield bills

GROTON – Tuesday night's discussion on the roughly $140,000 still owed to the contractors that completed improvements to the Fitch High School baseball field in July began an hour and a half later than expected. And once it did get started, it failed to produce an immediate answer to the question of how those contractors should be paid.

The conversation did, however, seem to leave both town and school district officials with an understanding of how they got into the current situation and what their next step should be for getting out of it.

While both the Town Council and schools Superintendent Paul J. Kadri agreed that the bills need to be paid, Mayor James L. Streeter said he didn't believe the discussion at Tuesday's council meeting should be about the financial resolution of the situation. He said the payment of the bills is a contract issue that would need to be discussed in executive session. 

Town Attorney Eileen C. Duggan concurred with Streeter's assessment.

"I think the purpose of tonight really was to get an understanding as to how we got to where we got to," Duggan said. "The next step would be to address how we deal with this shortfall, and that really is a pending claim litigation and a potential action issue that I think either needs to be addressed in an executive session or addressed with the attorneys."

Kadri had previously said he would like to pay the contractors as soon as possible using money the district receives each year from the federal Department of Defense. When he asked Duggan for clarification as to whether the bills could be paid now, she said payment should wait until discussions between the council, the Board of Education and their respective attorneys had taken place.

"Can we expedite that?" Streeter asked.

"Certainly," Duggan said.

The improvements to the field, which included the addition of bleachers, a press box, a fence and lights, among other things, were done to meet standards required by the New England Collegiate Baseball League. The work was overseen by the school district on behalf of the Mystic Schooners, an NECBL team that moved to Groton and played its first season at Fitch over the summer.
